Community Studio Rental: NOVEMBER
MONTH-TO-MONTH COMMUNITY STUDIO RENTAL AGREEMENT
This Agreement is made and entered into by and between Middlebury Studio School (hereinafter referred to as "MSS") and the undersigned renter (hereinafter referred to as "the Artist") for the shared rental of a community art studio space located at Middlebury Studio School in the State of Vermont, on the following terms and conditions:
1. Term and Rent
This is a month-to-month rental agreement, commencing on the first day of the month for which rent is paid. The Artist agrees to pay rent in the amount of $130.00 per month, due in full on or before the first day of each month. Payment shall be made either by check or through MSS’s registration system.
There is no security deposit required. Failure to pay rent on time may result in termination of this agreement.
2. Studio Access and Use
The Artist is renting a shared community studio space. There is no lock on the studio door, and the space is shared with two other artists.
The Artist will be provided with:
- A code to access the main entrance of the building, which is not to be shared with others.
- One (1) 6-foot folding table and one (1) chair for personal use during the rental term.
- One (1) 47” x 15” x 15” locker for storage of personal items and materials. Lockers must be completely emptied at the end of the rental period.
Artists are not permitted to use MSS art supplies or furniture beyond what is explicitly assigned, without prior permission from MSS.
This rental does not include access to any other studio spaces within the MSS building.
3. Security and Liability
The Artist is solely responsible for securing the building by locking the main door when entering or exiting. MSS is not liable for any missing, lost, or stolen property stored or left in the shared studio space or lockers.
4. Condition of Premises
The Artist agrees to maintain their work area in a clean and respectful condition throughout the rental period and to leave it in the same condition it was in upon move-in, reasonable wear and tear excepted. If the area is not returned in satisfactory condition, a $30 cleaning fee will be assessed.
The locker must also be fully cleaned out at the end of the rental term.
MSS will maintain the studio space in a temperature-controlled and comfortable condition.
5. Respectful Use and Conduct
As this is a shared studio space, the Artist agrees to:
- Respect the work, property, and noise preferences of the other artists using the studio;
- Refrain from playing loud music or engaging in disruptive activities;
- Use only the designated furniture and storage assigned to them;
- Ensure any shared resources (such as the sink or kitchenette) are left clean and usable.
There is to be no smoking, drinking of alcohol, or use of illegal drugs anywhere on the premises, including studios, common areas, parking lot, and surrounding grounds.
Open flames and fires are strictly prohibited. Use of any potentially hazardous materials (including solvents or resins) must be pre-approved by MSS.
6. Access by MSS
MSS retains the right for MSS staff to enter the community studio space at any time without prior notice.
7. Termination
The Artist may terminate this agreement or cancel their registration for the space within 5 days of the rental period. If the Artist cancels their registration within 5 days of the start of the month or during their rental period and a new renter is not secured by MSS, the Artist must still pay the month’s rent in full. MSS reserves the right to terminate this rental agreement at any time and has the right to ask the Artist to vacate the space if their behavior is deemed inappropriate for the shared community space. Failure to vacate or clean out the locker at the end of the rental period may result in additional charges.
8. Liability and Indemnification
The Artist assumes all risk of loss, theft, or damage to their personal property and artwork stored or created in the community studio. MSS is not responsible for any loss or damage, except where caused by its gross negligence or intentional misconduct.
The Artist agrees to indemnify and hold harmless MSS, its employees, and agents from any claims arising out of the Artist’s use of the premises.
9. Miscellaneous
This Agreement shall be governed by and construed in accordance with the laws of the State of Vermont. This document constitutes the entire agreement between MSS and the Artist and supersedes any prior understandings or agreements, whether oral or written.
